GENERAL TERMS OF BUSINESS
for real estate brokerage

1. INTRODUCTORY PROVISIONS

1.1 These General Terms of Business for Real Estate Brokerage (hereinafter referred to as the “General Terms”) govern the legal relationships between the real estate company and the client.

1.2 The General Terms are an integral part of every brokerage agreement concluded between the real estate company and the client. The current price list of the real estate company’s services and a copy of the insurance policy are also an integral part of every brokerage agreement.

1.3 If the brokerage agreement contains provisions that are inconsistent with these General Terms, the provisions of the brokerage agreement shall prevail.

2. DEFINITIONS

2.1 The terms used in these General Terms have the following meanings:

A real estate broker is a natural person who performs brokerage services for the real estate company based on an employment contract or other legal basis, holds a license issued by the competent ministry to perform brokerage activities, and is listed in the register of real estate brokers at the competent ministry.
Real estate brokerage means carrying out registered gainful activities of mediation in real estate transactions, which include establishing contact between the client and a third party and conducting negotiations and preparations for the conclusion of contracts related to specific real estate, such as sales, purchase, lease, or rental contracts for real estate.
The client is a natural or legal person who concludes a brokerage agreement with the real estate company and for whom the real estate company provides brokerage services.
A third party is a person whom the real estate company attempts to connect with the client for the purpose of negotiating the conclusion of a contract, the subject of which is real estate.
The client’s close family members include the client’s spouse or a person living with the client in a de facto union under the regulations governing marriage and family relations, their children or adoptees, parents, and persons whom the client is legally obligated to support.
A brokerage agreement is a written contract concluded between the real estate company and the client, whereby the real estate company commits to finding and establishing contact between the client and a third party for the purpose of negotiating a contract related to real estate, while the client agrees to pay the real estate company for the brokerage services if the contract is concluded.
A real estate contract refers to a sales, purchase, lease, rental, or other contract related to a specific real estate property, for which the real estate company provides brokerage services.
The real estate is the property defined in the brokerage agreement.

3. BROKERAGE SERVICES

3.1 The real estate company provides brokerage services for the sale or purchase of real estate, lease, rental, or other contracts related to real estate.
